Terms of Service (English)

These terms govern your use of the Casa Nakhla website and any booking you make with us. By using the site or booking, you agree to them. If you do not agree, please do not use the site.
Bookings & payment
The person booking must be at least 25 years old and must stay at the property for the reservation. Prices shown are estimates until confirmed; your booking is confirmed only when we accept it and payment is received.
Payments are made directly through third-party apps (Venmo, Zelle, PayPal, ATH Móvil). A refundable damage deposit applies as stated at booking and in your rental agreement.
Identity verification
To confirm a booking we require identity verification (a government photo ID of the primary guest plus a selfie). We may decline or cancel a booking that cannot be verified. See our Privacy Policy for how this data is handled and deleted.
Rental agreement & house rules
Every stay is subject to our House Rules and the rental agreement you sign. Those documents are part of these terms. No parties or events are permitted without a separate written event agreement.
Cancellations
Cancellation must be in writing (email is accepted); the timestamp of our receipt determines the effective cancellation date.
If we receive written notice 60 or more days before your arrival date, we retain the non-refundable reservation deposit (25% of the total) as liquidated damages and refund all other monies paid, including the refundable damage deposit, within 7 days.
If notice is received fewer than 60 days before arrival, all payments made to date are non-refundable and the renter remains liable for any unpaid balance of the total.
The refundable damage deposit is always returned in full when a stay is cancelled before check-in, less any charges already incurred. Weddings and special events follow this same schedule under their own event agreement, in which the reservation deposit paid to hold a date is non-refundable and credited toward the total.
AI concierge
Our concierge chat is an automated assistant provided for convenience. It can make mistakes and its answers are not guaranteed. For anything important — payments, availability, safety, or changes to your stay — confirm with us directly. It does not provide legal, medical, or financial advice.
Acceptable use
Don't use the site to break the law, disrupt or overload it, attempt unauthorized access, scrape data, or submit false or automated bookings. We may block or cancel abusive activity.
Property use & safety
You use the property and its amenities (including the pool, hot tub, and waterslide) at your own risk. There is no lifeguard; children must be supervised at all times. You are responsible for your group and for any damage caused during your stay.
Casa Nakhla is not responsible for island-wide power or water disruptions caused by the local utility companies, weather, or other events outside our control. We provide a whole-house backup generator and an on-site water reserve to help bridge outages, but we do not guarantee uninterrupted power or water, and no refunds are given for interruptions or for exhausted reserves. Intellectual property
The site's content, photos, and branding are owned by Casa Nakhla and may not be copied or reused without permission.
Disclaimers & limitation of liability
The site and stay are provided 'as is.' To the fullest extent allowed by law, Casa Nakhla is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid for your stay. Nothing here limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the Commonwealth of Puerto Rico and the United States, and disputes are handled in the courts located there.
Changes
We may update these terms; the date at the top shows the latest version. Continued use means you accept the changes.

Reservas y pago
La persona que reserva debe tener al menos 25 años y debe hospedarse en la propiedad durante la reserva. Los precios mostrados son estimados hasta confirmarse; su reserva se confirma solo cuando la aceptamos y se recibe el pago.
Los pagos se hacen directamente por aplicaciones de terceros (Venmo, Zelle, PayPal, ATH Móvil). Aplica un depósito de seguridad reembolsable según se indique al reservar y en su contrato de alquiler.
Verificación de identidad
Para confirmar una reserva requerimos verificación de identidad (identificación oficial con foto del huésped principal más una selfie). Podemos rechazar o cancelar una reserva que no pueda verificarse. Vea nuestra Política de Privacidad sobre cómo se maneja y elimina esta información.
Contrato de alquiler y reglas de la casa
Toda estadía está sujeta a nuestras Reglas de la Casa y al contrato de alquiler que usted firma. Esos documentos son parte de estos términos. No se permiten fiestas ni eventos sin un contrato de evento por escrito aparte.
Cancelaciones
La cancelación debe ser por escrito (se acepta correo electrónico); la fecha y hora en que la recibimos determina la fecha efectiva de cancelación.
Si recibimos el aviso por escrito 60 días o más antes de su fecha de llegada, retenemos el depósito de reservación no reembolsable (25% del total) como daños liquidados y devolvemos todo el demás dinero pagado, incluido el depósito de seguridad reembolsable, dentro de 7 días.
Si el aviso se recibe menos de 60 días antes de la llegada, todos los pagos hechos hasta la fecha no son reembolsables y el arrendatario sigue siendo responsable de cualquier saldo pendiente del total.
El depósito de seguridad reembolsable siempre se devuelve completo cuando una estadía se cancela antes del check-in, menos cualquier cargo ya incurrido. Las bodas y eventos especiales siguen este mismo calendario bajo su propio contrato de evento, en el cual el depósito de reservación pagado para apartar la fecha no es reembolsable y se acredita al total.

Nuestro chat de conserjería es un asistente automatizado ofrecido por conveniencia. Puede cometer errores y sus respuestas no están garantizadas. Para algo importante — pagos, disponibilidad, seguridad o cambios en su estadía — confírmelo con nosotros directamente. No brinda asesoría legal, médica ni financiera.
Uso aceptable
No use el sitio para infringir la ley, interrumpirlo o sobrecargarlo, intentar acceso no autorizado, extraer datos, o enviar reservas falsas o automatizadas. Podemos bloquear o cancelar actividad abusiva.
Uso de la propiedad y seguridad
Usted usa la propiedad y sus amenidades (incluidas la piscina, el jacuzzi y el tobogán) bajo su propio riesgo. No hay salvavidas; los niños deben estar supervisados en todo momento. Usted es responsable de su grupo y de cualquier daño causado durante su estadía.
Casa Nakhla no es responsable por interrupciones de electricidad o agua a nivel de la isla causadas por las compañías de servicios públicos, el clima u otros eventos fuera de nuestro control. Proveemos una planta eléctrica de respaldo para toda la casa y una cisterna de reserva de agua para ayudar a cubrir estas interrupciones, pero no garantizamos electricidad o agua ininterrumpidas, y no se otorgan reembolsos por interrupciones o por reservas agotadas. Propiedad intelectual
El contenido, las fotos y la marca del sitio son propiedad de Casa Nakhla y no pueden copiarse ni reutilizarse sin permiso.
Descargos y limitación de responsabilidad
El sitio y la estadía se ofrecen 'tal cual'. En la máxima medida permitida por la ley, Casa Nakhla no es responsable por daños indirectos o consecuentes, y nuestra responsabilidad total se limita al monto que usted pagó por su estadía. Nada aquí limita la responsabilidad que no puede limitarse por ley.
Ley aplicable
Estos términos se rigen por las leyes del Estado Libre Asociado de Puerto Rico y los Estados Unidos, y las disputas se atienden en los tribunales ubicados allí.
Cambios
Podemos actualizar estos términos; la fecha en la parte superior muestra la versión más reciente. El uso continuo significa que acepta los cambios.
